write a response to this: In the United States of America, healthcare is notorious for being difficult to obtain and impossible navigate. Many travelers are surprised to learn that the United States, albeit a powerful and progressive country, does not provide free universal healthcare for its citizens. Why is that? The answer lies in the foundation that this country was built on and America’s rich history of independence and individualism. If I was talking to a citizen of a country where socialized medicine is the legal norm and I had to explain our country’s healthcare system, I’d say the sad truth is that healthcare is not considered a fundamental right in American law. This is bolstered by Supreme Court cases like the 1901 case of Hurley v. Eddingfield which helped enact the “no-duty-to-treat” principle (Wilensky & Teitelbaum, 2023). The no-duty principle states that a provider has the right to choose who and when they treat patients. Rather than being obliged to treat anyone just because need calls for it. This case also cemented that a physician-patient relationship is not a continuous one, it must be maintained and renewed regularly (Wilensky & Teitelbaum, 2023). These two principles alone are effective in making universal healthcare very difficult in this country. Despite this, there are a couple of federal and state laws that allow some individuals to attain healthcare and try to combat this “no-duty principle.” Policies such as the Examination and Treatment for Emergency Medical Conditions and Women in Labor Act (EMTALA) allows all individuals to receive healthcare regardless of their financial situation in the event of an emergency (Wilensky & Teitelbaum, 2023). This is the only true universal health right that exists in the United States. I am not particularly proud that this is the state of the healthcare system in America today. If I had to choose a silver lining, I would try and highlight that there is at least a universal right to emergency services here in the United States.
