Original Question
Identify and summarize two of the laws/regulations that Peter chose to include in the in-service, then explain the importance and purpose and how it impacts Protected Health Information. Explain the legal/ethical issues presented in the case study and how it impacts the management of health information. Summarize one additional topic that you would suggest be included in the presentation to ensure the staff understand the impact of these legal/ethical issues. Case Study: Lately, the medical group administrators of MIT have noticed an increase in reports regarding potential breaches of protected health information (PHI). Christine, chief information officer (CIO), who receives the incident reports, identified a variety of concerns that have been shared with the administrators. Below is a list of the types of reporting: Associates computer remaining open and accessible while away from their workstation Lost USBs with protected health information Lost Laptops/tablets used by providers Nurse post on personal social media account pertained information regarding a patient’s treatment at MIT The CIO set up meetings with each associate involved in the incidents and discovered that some failed to show any remorse, while others were unable to recall the organizations policies regarding PHI. The CIO was disturbed by the responses and felt concerned about the possibility that other rules and regulations regarding patient confidentiality were being violated. Immediately, the CIO gathered the leadership team to discuss the necessity of conducting an in-service for all associates, as it would be valuable to ensure all associates are educated on the organization policies, along with the rules and regulations of privacy and security of patient information. Peter, the CIO’s assistant was asked to work on the committee tasked with sharing information about why these forms of technology are used in the office and why patient information must be protected and kept secure by all associates. Some of the topics selected to review in the in-service was: HITECH Act, PPACA, HIPAA, and different accrediting agencies that MIT work with. Peter also wanted to enforce that each regulation component impacts the use of technology. He wanted to focus on how the breaches, either legal or ethical impact patient care, health outcomes, and PHI. The CIO and leadership team are hopeful that the in-service will help educate each associate and demonstrate the importance of protecting patient information and using patient information in a respectable manner.
